Terms of Service

SplashRoster (“SplashRoster,” “we,” “us”) provides software that helps independent swim instructors and swim schools (“you,” the “Instructor”) run their business — including a website, online booking and scheduling, payment processing, messaging, and inbox tools. We provide the software; you run your own swim school and are responsible for the lessons, instruction, safety, and services you deliver to families.

You must provide accurate information and are responsible for activity under your account and for keeping your credentials secure. You must be authorized to operate the swim school you register and to enter into these terms. You are responsible for your staff members’ use of the platform.

You agree not to misuse the platform: no unlawful, harmful, or fraudulent activity; no infringing content; no attempts to breach security, reverse engineer, or disrupt the service; and no use that violates the rights of families or third parties. You are responsible for the content you upload and for having the right to use it.

The families and children you serve are your customers. As between you and SplashRoster, you are the controller of that information and SplashRoster is your processor — we handle family and child data on your behalf to provide the service, under your instructions, as described in our Privacy Policy. You are responsible for collecting any parental consents required by law and for the accuracy of the health and personal information you record.

Paid plans are billed monthly in advance through our payment processor. Free trials, if offered, convert to a paid subscription unless canceled before the trial ends. A per-transaction platform fee may apply to payments you collect from families. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice; changes apply to the next billing cycle.

Payments from families are processed by Stripe and settle to your connected Stripe account. You are the merchant of record for those transactions and are responsible for refunds, chargebacks, disputes, taxes, and your obligations under Stripe’s terms. SplashRoster does not hold your funds.

You keep ownership of your content and your business data. You grant us the limited rights needed to host and operate the service for you. You can export your data (rosters, payments, and more) while your account is active. On termination we will make your data available for export for a reasonable period, then delete it in the ordinary course.

We work to keep the platform reliable but do not guarantee uninterrupted or error-free operation. We may update, change, or discontinue features. We are not a substitute for your own safety practices, records, or judgment as an instructor.

The service is provided “as is” without warranties of any kind to the fullest extent permitted by law. To the extent permitted by law, SplashRoster is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amounts you paid us in the three months before the claim.

You may cancel at any time. We may suspend or terminate accounts that violate these terms or create risk to families, other users, or the platform. Sections that by their nature should survive termination will do so.

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. We may update these terms; material changes will be communicated in advance, and continued use after they take effect means you accept them.
